Welcome to www.thisfitmum.com (the “Website”), operated by ThisFitCrew Ltd trading as ThisFitMum (referred to as “we,” “our,” or “us”). By purchasing any digital products, coaching services, subscriptions, or physical goods through this Website, you agree to be bound by these Terms and Conditions of Sale. If you do not agree, please refrain from purchasing any products or services.
1. Introduction
These Terms and Conditions govern the sale of digital products, online coaching services, subscriptions, and physical merchandise on the Website and form a legal agreement between you and ThisFitCrew Ltd trading as ThisFitMum.
2. Eligibility
You must be 18 years of age or older to purchase products or services from this Website. By placing an order, you confirm that you meet this requirement.
3. Delivery of Products
Digital Products & Coaching
Digital products including ebooks, workout guides, meal plans, training programmes, downloadable resources, and coaching materials are delivered via email, download link, or account dashboard upon successful payment.
Please ensure your email address is correct when placing your order. If you do not receive your product, please check your spam or junk folder before contacting us.
Diet and fitness coaching acknowledgement will usually be sent on the day of purchase with further onboarding and registration instructions.
Coaching plan set up and onboarding may take up to 7 business days from completion of registration forms, payment, and submission of all required information.
Physical Merchandise
Non personalised merchandise will be shipped directly by us. Delivery timelines will be advised at checkout.
Personalised merchandise is fulfilled by our partner, Red Hot Source Ltd (www.redhotsource.co.uk). Delivery and return terms for these items are governed by their policies and procedures.
4. Payment and Pricing
All prices listed on the Website are in GBP (£).
Payment must be made in full at the time of purchase unless otherwise agreed.
We reserve the right to amend pricing at any time, however pricing changes will not affect purchases already completed.
Initiating unjustified chargebacks or payment disputes for validly delivered services, subscriptions, or digital products may result in immediate termination of services and recovery action where appropriate.
4A. Online Diet and Fitness Coaching
Coaching plans are billed on a monthly recurring basis, one month in advance unless otherwise stated.
No fixed term contract applies unless specifically stated. Cancellation requires a minimum of one months notice before the next billing date.
Fixed duration programmes including but not limited to SHRED or challenge based programmes must be paid in full before cancellation.
Cancellation of recurring coaching plans will stop future billing after the notice period but does not entitle the client to refunds for payments already processed.
Coaching plans and subscriptions cannot be paused or frozen unless agreed in writing by ThisFitCrew Ltd.
No Contact plans refer to self managed coaching options that do not include regular coach communication, weekly check ins, or guaranteed response times unless explicitly stated within the plan description.
Non payment may result in suspension or termination of coaching services and access to coaching platforms or materials.
5. Returns and Refunds
Digital Products
All downloadable plans, digital products, guides, and resources are non refundable once delivered except in cases of technical faults, duplicate purchases, or where legally required.
Coaching Services
Refundable minus any deposit, set up fee, onboarding fee, or holding fee only until the programme has started.
Once the programme, coaching plan, onboarding, or personalised materials have been delivered, no refunds will be issued and start dates cannot be moved unless agreed at our discretion.
Non Personalised Physical Goods
Return and refund period is 14 days from receipt.
The buyer is responsible for return shipping costs. We recommend using a tracked postal service as we cannot accept responsibility for items lost in transit.
To start a return, email thisfitmum.uk@gmail.com with your order number and reason for return.
Items showing excessive wear, tampering, misuse, or damage may be refused or subject to a restocking fee.
Personalised Merchandise
Personalised items fulfilled by Red Hot Source Ltd are subject to their fulfilment and returns policy.
Faulty or damaged items must be reported directly to them for replacement or refund where applicable.
6. Copyright and Intellectual Property
All content including ebooks, meal plans, training plans, videos, graphics, guides, coaching materials, and Website content are protected by copyright and intellectual property laws owned by ThisFitCrew Ltd trading as ThisFitMum.
All materials are for personal use only and must not be copied, reproduced, distributed, shared, resold, modified, or used commercially without prior written permission.
7. Disclaimer of Warranties
Results will vary between individuals based on factors including adherence, hormones, medical conditions, lifestyle, training history, stress, sleep, genetics, nutrition compliance, medications, and overall health status.
No specific weight loss, physique, health, muscle gain, or performance outcomes are guaranteed.
All products and services are provided on an “as is” basis without warranties or guarantees of specific results.
8. Limitation of Liability
To the fullest extent permitted by law, ThisFitCrew Ltd trading as ThisFitMum shall not be liable for indirect, incidental, consequential, or special damages arising from the use of our products or services.
Nothing within these Terms excludes liability for death or personal injury caused by proven negligence or any liability that cannot legally be excluded under English law.
9. Medical Disclaimer
All coaching services, nutrition guidance, exercise programmes, and educational materials are provided for educational and informational purposes only and are not intended as medical advice, diagnosis, or treatment.
You should consult a qualified healthcare professional before beginning any exercise, nutrition, supplementation, or lifestyle programme.
By purchasing coaching services, you confirm that all health, lifestyle, and medical information provided is accurate and complete to the best of your knowledge.
You accept full responsibility for your participation in any exercise, nutrition, or lifestyle programme and acknowledge that participation carries inherent risks.
10. Client Conduct
We reserve the right to terminate coaching services, platform access, subscriptions, or communication without refund where abusive, threatening, inappropriate, discriminatory, or persistently non compliant behaviour occurs.
11. Privacy and Data Protection
Personal information submitted through coaching forms, check ins, questionnaires, subscriptions, and purchases will be processed in accordance with our Privacy Policy.
12. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
